Practice Description: Nathan Cardon's practice focuses on product safety, privacy, data security, advertising, energy efficiency, labeling, and other fields related to consumer protection. He has extensive experience applying, interpreting, and drafting regulations within these areas. In his product safety practice, Mr. Cardon counsels clients on risk management and product safety strategies, responses to allegations of incidents or unsafe products. He also advises on compliance with Consumer Product Safety Commission (CPSC) requirements, including those of the Consumer Product Safety Act, the Consumer Product Safety Improvement Act, the Federal Hazardous Substances Act, the Poison Prevention Packaging Act, and others. In addition, Mr. Cardon helps clients address the increasing array of state consumer product requirements, with special emphasis on green chemistry reporting and packaging warning requirements. In his privacy, data security, and advertising practice, Mr. Cardon is involved in a wide variety of consumer protection matters. This includes compliance with laws, regulations, and standards governing connected products, children's privacy, marketing to children, cross-device tracking, mobile apps, commercial email messages, online behavioral advertising (OBA), contests and sweepstakes, endorsements and testimonials, data breach notification, and cybersecurity. Mr. Cardon counsels clients on the listing and delisting of substitutes for ozone-depleting substances under the Montreal Protocol and the Environmental Protection Agency's Significant New Alternatives Policy Program. He assists appliance manufacturers on energy efficiency requirements, as well as accessibility requirements. Prior to joining Keller and Heckman, Mr. Cardon was a senior counsel to Commissioner Nancy A. Nord at the CPSC. In earlier private practice, he assisted clients in compliance investigations related to federal regulations, government contracts requirements, and congressional ethics rules.
